Waiver, Release of Liability, Assumption of Risk, and Indemnification Agreement

In consideration for being allowed to participate in any program, practice, training session, clinic, camp, league, tournament, travel event, strength and conditioning session, transportation activity, or related activity offered, operated, organized, or sponsored by Ball Never Lies Basketball Club, LLC (“BNL” or “Organization”), the undersigned parent/legal guardian and participant agree as follows:

1. Acknowledgment of Risks

I acknowledge and understand that participation in basketball and related athletic activities involves inherent and significant risks of injury, illness, permanent disability, paralysis, emotional distress, property damage, and death. These risks may result from, including but not limited to:

• Physical contact with other participants


• Falls, collisions, slips, trips, and equipment failure


• Overexertion, dehydration, heat illness, cardiac events, or medical emergencies


• Negligence of participants, coaches, officials, volunteers, or others


• Inadequate skill level or conditioning


• Dangerous or defective premises or equipment


• Weather conditions, including heat, rain, storms, or other environmental hazards


• Transportation to and from activities


• Unsportsmanlike conduct, horseplay, or reckless behavior


• Exposure to infectious diseases, viruses, bacteria, or other health conditions, including but not limited to COVID-19, influenza, MRSA, or other communicable diseases

I voluntarily assume all risks, known and unknown, even if arising from the negligence of BNL or any released party, to the fullest extent permitted by law.

2. Medical Fitness and Consent

I certify that the participant is physically fit and able to safely participate in BNL activities. I understand that BNL does not provide medical insurance for participants.

I authorize BNL staff, coaches, volunteers, or representatives to obtain emergency medical treatment for the participant if necessary. I understand and agree that I am solely responsible for any medical expenses incurred as a result of participation.

I further agree to disclose any medical conditions, allergies, injuries, restrictions, or medications that may affect participation.

3. Release and Waiver of Liability

To the fullest extent permitted by law, I, on behalf of myself, the participant, and our heirs, assigns, personal representatives, and next of kin, hereby release, waive, discharge, and covenant not to sue:

• Ball Never Lies Basketball Club, LLC


• Its owners, directors, officers, employees, coaches, trainers, volunteers, contractors, agents, and representatives


• Any tournament operators, leagues, sponsors, advertisers, schools, school districts, municipalities, facility owners, landlords, or venues used for activities

(collectively referred to as the “Released Parties”)

from any and all claims, demands, actions, causes of action, liabilities, damages, losses, costs, or expenses of any kind, including attorney’s fees, arising out of or related to participation in BNL activities, including claims arising from the NEGLIGENCE of the Released Parties, to the fullest extent permitted by law.

4. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, costs, expenses, or attorney’s fees arising out of:

• The participant’s actions or conduct


• Any damage to property or injury to another person caused by the participant


• Any claim brought on behalf of the participant contrary to this Agreement

5. Code of Conduct and Removal

I understand that BNL reserves the right to remove, suspend, or dismiss any participant or parent/guardian from any activity, team, event, or facility for misconduct, unsafe behavior, unsportsmanlike conduct, fighting, harassment, bullying, inappropriate language, failure to follow team rules, or behavior deemed detrimental to the organization, with or without refund.

6. Transportation and Travel

I understand that participation may involve travel to practices, games, tournaments, hotels, or other venues. I acknowledge that transportation-related risks exist whether transportation is organized by BNL, another parent, volunteer, or third party. I voluntarily assume all transportation-related risks.

7. Photo, Video, and Media Release

I grant permission to BNL to photograph, film, record, or otherwise capture the participant’s name, image, likeness, voice, and performance during participation for promotional, educational, marketing, social media, website, livestream, or commercial purposes without compensation or further approval.

8. No Guarantee

I understand that participation in BNL programs does not guarantee playing time, team placement, exposure, recruitment opportunities, scholarships, athletic advancement, or future participation.

9. Severability

If any portion of this Agreement is found unenforceable or invalid, the remaining provisions shall remain in full force and effect.

10. Governing Law

This Agreement shall be governed by and interpreted under the laws of the State of Rhode Island.

11. Acknowledgment and Understanding

I acknowledge that I have carefully read this Waiver and Release Agreement, fully understand its terms, understand that I am giving up substantial legal rights on behalf of myself and the participant, and sign it freely and voluntarily without inducement.

I further certify that I am the parent or legal guardian of the minor participant and have the authority to sign this Agreement on the participant’s behalf.
